TERMS AND CONDITIONS
AGREEMENT TO TERMS AND CONDITIONS – By making a payment to World Travel Ninja, you agree to the Travel Terms and Conditions set forth herein on behalf of yourself and all participants traveling in your party. It is vitally important that you read all these Terms and Conditions. If you have any questions about these Terms and Conditions, you should contact us before making any booking.
AUTHORIZED CHARGES: You authorize World Travel Ninja to provide your credit card information to suppliers to make payment for their services on your behalf. (Only applies for airline upgrades - we do not store nor have access to your credit card information for online orders). You acknowledge that all payments to World Travel Ninja are non-refundable.
SUPPLIERS: If World Travel Ninja processes your credit card as payment, you agree to the following: World Travel Ninja services consist of facilitating the sale and paying the Suppliers, and once World Travel Ninja provides said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operation, your only recourse will be against the Supplier.
TRAVEL INSURANCE: As part of the tour price, World Travel Ninja will purchase airline travel insurance. Any travel insurance beyond that is the responsibility of the traveler to procure. World Travel Ninja strongly recommends that you consider purchasing additional travel insurance that offers coverage for many things, including trip cancelation/interruption, emergency medical/dental, emergency evacuation etc. You can search online for travel insurance and compare plans offered by various insurers. World Travel Ninja is not an insurer and is not responsible for covered determinations or the payment of any covered claims. World Travel Ninja is not qualified or authorized to answer technical questions about the benefits, exclusions, or conditions of any insurance coverages in the plan or to evaluate the adequacy of your existing insurance coverage.
TRAVEL DOCUMENTS: You understand that the Transportation Security Administration (TSA) requires you to carry a government issued identification card to board a flight. You further acknowledge that beginning on October I, 2021, you must present a driver's license or other form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information). You have been advised that the name, date of birth and gender that appears on the ID card must exactly match the same such data that is listed on your airline ticket(s) and in booking record(s). You acknowledge that failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint.
For travel to a foreign country, a government issued, non-expired U.S. passport book (with at least four blank visa pages) is required, regardless of age, for the destinations to which you are traveling. The name on your reservation must match exactly the name on your passport. Look at the expiration date on your passport. Please make sure your passport is valid for at least 6 months after travel is completed. (Some countries require one year or longer.) Children under the age of 18 traveling with only one parent or someone who is not a parent or legal guardian should travel with a notarized letter of consent. U.S. citizens may be denied entry to a country if they have ever been charged or convicted of a serious crime, including a DUI. Disability accommodations vary widely by country and supplier. It is your responsibility to disclose any disability that may impact travel and to provide the correct documentation as described. Failure to do so may result in denied boarding or entry. We are unable to refund unused flights, hotels, or add-ons because of denied boarding or denied entry to a foreign country. You agree to review your travel documents for accuracy upon receipt and understand that you may contact World Travel Ninja if you have any questions. You understand that discounted fares typically involve restrictions and that changing any aspect of your travel arrangements may result in the payment of additional money.
HOTEL ROOMS: International hotel rooms are typically smaller and less standardized than those in the US and do not always offer air conditioning, refrigerator, television, Wi-Fi etc. A double-occupancy room may have two single beds placed side by side. Also, single rooms may be smaller than twin rooms and may not have as desirable a location within the hotel.
LUGGAGE POLICY: It is your responsibility to research and comply with all airline luggage restrictions relating to your trip. Trips that include on-tour flights often restrict the weight and size of your luggage to lower weight and smaller size than international flights. World Travel Ninja will provide you the luggage restrictions for any on-tour flights.
ON-TOUR CONDUCT EXPECTATIONS: You acknowledge and agree that any form of physical or verbal abuse including racism or derogatory comments regarding sexual orientation directed towards fellow group members, the tour host, or any individuals encountered during the tour is strictly prohibited. In the event of such misconduct as determined by our tour host or acting tour host, you understand that you will be required to leave the tour immediately. Additionally, you shall assume full responsibility for arranging your own airfare home and covering all associated expenses. Furthermore, if you violate any government regulations or rules set forth by our tour host and/or vendors, you will similarly be asked to leave the tour and be held accountable for arranging your return airfare and all related costs.
HEALTH & CAPABILITIES: You understand and agree that it is essential for you to have the physical capability to walk throughout the tour. You participate in the activities of the trip at your own risk. By taking part in the activities, you incur and assume all the risks that such activities present. As World Travel Ninja is not qualified to evaluate your fitness, you (or your doctor) must evaluate your fitness for any given tour or activity. If the tour host determines significant difficulties with your mobility, you may be requested to stay on the bus, stay at your hotel, and/or depart from the group. In such circumstances, you shall be responsible for arranging your own transportation and covering all expenses associated with your return home.
World Travel Ninja regrets that it cannot provide special assistance for walking, wheelchairs, motorized scooters, dining or other personal needs. If you need such assistance, you must be accompanied by an able companion who will assist you. We regret that some itineraries cannot accommodate wheelchairs or motorized scooters. We may require you to produce a doctor’s certificate certifying you are fit to partake in the trip. If we are unable to reasonably accommodate your needs or believe that your health and safety could be compromised, we reserve the right to refuse you a place on the trip.
ITINERARY CHANGES AND FLEXIBILITY: World Ninja Travel makes every effort to operate all trips as advertised. Travelers should be flexible as situations may arise that necessitate changes to the itinerary. World Ninja Travel reserves the right to alter or curtail the itinerary and substitute hotels, sightseeing and/or conveyances as it is deemed necessary.
PHOTOGRAPHS AND VIDEOS ON TOUR: You acknowledge that photographs and/or video taken of you during the tour may be utilized for promotional purposes. By agreeing to these terms, you willingly waive any rights you may have to these photographs.
LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE: You acknowledge and understand and agree that: (1) airlines, cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms; (2) Airline schedule changes. mechanical or weather delays may affect flight times. Your connecting flights and/or transportation to and from the start and end point, whether issued by World Travel Ninja or on your own arrangement, may be affected. World Travel Ninja is not responsible for missed connections, delays, and/or cancelations. Once your first flight has commenced the air carrier controls your reservation. Any flight delays, missed connections, or cancelations must be re-scheduled by the responsible airline.
World Travel Ninja has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, climate extremes, or suitability of booked services for any person. For information concerning possible dangers at destinations, World Travel Ninja recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information World Travel Ninja recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying all passport, visa, vaccination or other entry requirements of your destination(s), and all conditions regarding health, safety. security. political stability. and labor or civil unrest at such destination(s). You hereby release World Travel Ninja from all claims arising out of any problem covered in this section. You agree that the courts in Washington County, State of Utah in the United States will be the exclusive jurisdiction for all claims brought by you or World Travel Ninja. and you hereby submit to the personal jurisdiction of those courts.
All bookings are accepted by World Travel Ninja as agent for the travel suppliers on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operator suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their respective Web sites. BECAUSE WORLD TRAVEL NINJA ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE WORLD TRAVEL NINJA IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. WORLD TRAVEL NINJA HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH WORLD TRAVEL NINJA’S OFFICE OR THROUGH THIS WEB SITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF WORLD TRAVEL NINJA’S CONTROL, AND YOU HEREBY EXONERATE WORLD TRAVEL NINJA FROM ANY LIABILITY WITH RESPECT TO THE SAME. Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of World Travel Ninja’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of World Travel Ninja. World Travel Ninja reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time. World Travel Ninja shall not assume any responsibility for any air and/or ground schedule changes. World Travel Ninja has solely received commission and fees for travel transactions and Customer agrees and understands that any recovery from World Travel Ninja will be limited to the commission and fees paid by Customer received by World Travel Ninja.
FORCE MAJEURE: “Force Majeure” means, in relation to World Travel Ninja, any circumstances beyond the reasonable control of World Travel Ninja, (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).
World Travel Ninja shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
If World Travel Ninja, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by World Travel Ninja to you because of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although World Travel Ninja shall use its reasonable efforts to reimburse you where possible. However, World Travel Ninja shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to World Travel Ninja of the Force Majeure and applicable cancellation fees.
Regarding civil unrest, once World Travel Ninja has investigated the prevailing situation, as it deems fit, it shall remain in WORLD TRAVEL NINJA’s sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to World Travel Ninja’s and each supplier’s terms and conditions.
